Terms of Use

These Terms of Service ("Terms") govern your access to and use of the Ungrip mobile application and related services (collectively, the "App") provided by Caner Tekin ("Ungrip," "we," "us," or "our").

By downloading, installing, accessing, or using the App, you acknowledge that you have read, understood, and agree to be legally bound by these Terms and our Privacy Policy.

If you do not agree to these Terms, you must stop using the App and delete it from your device.

Important Disclaimers

Medical and Educational Disclaimer

Ungrip is a self-help and habit-tracking application designed to support users seeking to change compulsive behavioral patterns. The App:

• is not a medical service;
• is not therapy or counseling;
• is not a medical device;
• does not diagnose, treat, cure, or prevent any condition.

Nothing contained in the App constitutes medical advice, diagnosis, or treatment. No doctor–patient, therapist–client, or healthcare-provider relationship is created by use of the App. The self-reported score and any insights the App shows you are informational reflections of your own answers — they are not a clinical assessment.

If you are experiencing mental-health distress, addiction concerns, or a crisis situation, you should consult a qualified healthcare professional. The App is not a substitute for professional treatment. The App provides links to third-party crisis helplines as a convenience; we do not operate, control, or take responsibility for those services.

Behavioral Health Disclaimer

The App addresses topics related to compulsive behaviors and habit change, which may involve sensitive personal, emotional, or psychological issues. You acknowledge and agree that:

1. Individual results vary. Behavioral change is highly individualized. The App does not guarantee any particular result, including abstinence, relapse prevention, or emotional improvement.
2. Risk of emotional distress. Tracking behaviors, viewing your own logs, or reflecting on your patterns may cause emotional reactions including stress, frustration, or disappointment. Such reactions are a normal possibility when engaging with habit-tracking tools.
3. Not a clinical program. The App does not provide addiction treatment, behavioral therapy, or psychological counseling.
4. User responsibility. You remain solely responsible for your personal decisions and actions. Decisions about behavioral change or mental-health treatment should be made independently or in consultation with qualified professionals.
5. Release of behavioral-harm claims. To the maximum extent permitted by law, you agree that Ungrip shall not be liable for claims arising from relapse or inability to change habits, emotional distress related to habit tracking, or reliance on the App's insights or tracking tools.

1. Eligibility

You must be at least 16 years old, or the age of digital consent in your jurisdiction, to use the App. If you are under 18, you represent that a parent or guardian has reviewed these Terms and that your use is supervised where required by law.

2. No Account Required

Ungrip does not require you to create an account, provide an email address, or register any personal identifier to use the App. Because the App has no account system, you are responsible for the security of your own device. If you delete the App or lose access to your device, your on-device data cannot be recovered by us — we never receive or store a copy of it.

3. License to Use the App

Subject to your compliance with these Terms, Ungrip grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to download and use the App solely for personal, non-commercial purposes. All rights not expressly granted are reserved by Ungrip.

4. Intellectual Property Ownership

The App and all related technology — including its software, designs, graphics, text, branding, trademarks, logos, user-interface elements, scoring logic, and written content — are and remain the exclusive property of Ungrip or its licensors, and are protected by applicable intellectual-property laws.

5. Intellectual Property Restrictions

You may not, directly or indirectly: copy, reproduce, modify, distribute, sell, license, or create derivative works of the App; reverse engineer, decompile, or disassemble any portion of the App; attempt to extract source code or scoring logic; use the App to build a competing product; use the App or its content to train machine-learning or artificial-intelligence systems; or bypass security protections. Any unauthorized use may result in termination of access and legal action.

6. AI Training Prohibition

You may not use the App, its content, or its underlying technology to train, develop, fine-tune, or improve any artificial-intelligence, machine-learning, or large-language-model system without our prior express written consent.

7. Your Data Stays on Your Device

Ungrip is built so that the information you enter — quiz answers, logs, notes, banked clean days — is stored only on your device. We do not operate a server that receives this content, and we cannot access, read, sell, or share it, because we never have it. You retain full ownership and control of your on-device data. You may export it or delete it at any time from within the App. See our Privacy Policy for details.

8. Prohibited Conduct

You agree not to: violate any applicable law in connection with the App; reverse engineer or tamper with the App; use the App for any unlawful purpose; or interfere with the App's functionality.

9. Subscriptions and Billing

Certain features of the App require a paid subscription or a one-time purchase. Subscriptions and purchases are processed through the Apple App Store (and, where offered, Google Play). Payment processing and billing are governed by the applicable platform provider. Auto-renewing subscriptions renew until cancelled; you can cancel anytime in your App Store account settings. A lifetime purchase is a one-time, non-recurring purchase. All fees are non-refundable except where required by applicable law or platform policy. Refund requests are handled by the platform provider (Apple/Google), not by Ungrip. We reserve the right to modify pricing with reasonable notice for future billing periods.

10. Beta and Changing Features

From time to time we may release experimental features or change, add, or discontinue features. Such features are provided "as is" and may contain errors.

11. Third-Party Services

The App may link to third-party services, including external crisis helplines and the platform app stores. We are not responsible for third-party content, policies, or data practices. If the App is downloaded from the Apple App Store, you acknowledge that these Terms are between you and Ungrip, not Apple Inc., and that Apple has no responsibility for the App. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

12. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE APP AND ALL RELATED CONTENT AND FEATURES ARE PROVIDED "AS IS," "AS AVAILABLE," AND "WITH ALL FAULTS." UNGRIP DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AND UNINTERRUPTED OR ERROR-FREE SERVICE.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, UNGRIP SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR EXEMPLARY DAMAGES, INCLUDING EMOTIONAL DISTRESS, LOSS OF DATA, OR LOSS OF PROFITS, ARISING OUT OF OR RELATED TO THE APP OR THESE TERMS. IN NO EVENT SHALL UNGRIP'S TOTAL CUMULATIVE LIABILITY EXCEED THE GREATER OF ONE HUNDRED DOLLARS ($100 USD) OR THE TOTAL AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

14. Indemnification

You agree to indemnify and hold harmless Ungrip and its affiliates, officers, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of your use of the App, your violation of these Terms, or your violation of any law or third-party right.

15. Dispute Resolution

If you have a problem with the App, please contact us first at support@getungrip.com — most issues can be resolved informally and quickly.

Any dispute arising out of or relating to these Terms or your use of the App that cannot be resolved informally shall be subject to the exclusive jurisdiction of the courts and enforcement offices of Istanbul (Çağlayan), Republic of Türkiye.

Consumer rights are preserved. Nothing in this section removes any mandatory right you have under the consumer-protection law of your country of residence. If you are a consumer, you may also bring proceedings in the courts of your place of residence, and you retain access to any consumer arbitration committee, ombudsman, or alternative dispute resolution body available to you under local law. Turkish consumers retain their rights under Law No. 6502 on the Protection of Consumers, including application to the relevant Consumer Arbitration Committee (Tüketici Hakem Heyeti) where applicable.

16. Termination

We may suspend or terminate your access to the App at any time if you violate these Terms or misuse the App.

17. Corporate Transactions

If Ungrip undergoes a merger, acquisition, or sale of assets, our rights under these Terms may be transferred to the successor entity. Because we do not hold your personal on-device data, no such data is transferred as part of any transaction.

18. Export Compliance

You may not use or export the App in violation of applicable export-control or sanctions laws.

19. Governing Law

These Terms are governed by the laws of the Republic of Türkiye, without regard to its conflict-of-laws principles.

20. Changes to These Terms

We may update these Terms from time to time. Material changes will be reflected by updating the "Last Updated" date. Continued use of the App after changes take effect constitutes acceptance.

21. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Ungrip regarding the App.
